5 Things To Avoid While Out On Bail

Blog

The eighth amendment of the U.S. Constitution provides you with the right to get out of jail while awaiting trial. This right comes with rules, and it does not matter if you post your bail bonds or pay one of the bail bonds services to post it. There are numerous things that you should not do while you are out on bail and awaiting your trial. Here are a few of them.

1. Other Defendants

If there are numerous alleged defendants involved in your case, you may want to steer clear of them until you resolve your charges. Sometimes the court may view your continued association as collusion, which could further hurt your case.

Steer clear of anywhere or anyone the court may view as a criminal element. Even an innocent association has the potential for the court to misinterpret.

2. Additional Criminal Charges

The last thing you want to do while out on bail is get arrested on new charges. The court will view these additional charges in a harsher light and may also revoke your current bail bonds or impose stiffer bail conditions.

3. Drugs And Alcohol

Many times one of the bail conditions the bail bondsman reviews with you is avoiding all drugs and alcohol while you are out on bail. The court may also subject you to routine drug testing if you have drug or alcohol-related charges. Failing this test may result in you returning to jail. Is a beer worth it?

4. Weapons

Being found in possession of any weapon while you are out on bail may result in the court revoking your bail. While most people only think about firearm possession, weapons can also include the following:

  • Knives
  • Brass or iron knuckles
  • Bludgeon
  • Hammers
  • Baseball bats
  • Certain poisonous chemicals

In all actuality, most things can be a weapon if misused. For example, the police may even consider a pillow a deadly weapon if you use it to smother your spouse. But this is not something the police are going to arrest you for having possession of.

5. Missing Court

Above all else, one of the most important things you want to avoid while out on bail is missing any required hearing dates or court-ordered meetings. Write down your dates, and ensure you have transportation. The court is not interested in any excuses. Failure to show up for court almost guarantees the court issuing a bench order for your arrest and revoking your bail.
